Orangevale father, son sentenced for child sexual assaults decades ago

A father-son duo has been sentenced to lengthy prison terms for ghastly crimes committed against children in Orangevale, California, some decades ago. In a shocking revelation, the crime came to light when hidden evidence was discovered during renovation at the house—an example of how such crimes leave an indelible mark on people and the fact that, come what may, justice must be pursued at all costs, even if much time has passed.

In 2021, a citizen purchased a home in Orangevale, roughly 25 miles northeast of Sacramento, that had been owned by a single family for over 40 years. While renovating an abandoned outbuilding on the property, he discovered something revolting: explicit Polaroid photographs and VHS videotapes depicting child exploitation came tumbling out from behind the walls and sheetrock. Authorities later said the cache amounted to more than 400 images, taken roughly between 1985 and 1995, showing children under the age of 14 being abused. The discovery became a turning point in the investigation, bringing to light the atrocious acts that had occurred within the walls of this unassuming home. The homeowner was horrified by the revelation and immediately contacted the Sacramento County Sheriff’s Office. “I’ve seen a lot of interesting things here in our cleaning up of the property, but this was different,” the new owner, who asked not to be identified, told Sacramento news station KCRA 3 at the time. An in-depth investigation followed, in which detectives located the victims—now adults—and learned how they had been abused as very young children.

The attackers were identified as Theodore Smith, a former occupant of the Orangevale home, and his son James Smith. By then both men had relocated to Alto, a rural community in East Texas about 55 miles outside Tyler. Once they were identified as people of interest, investigators searched their Texas residence, and the pair were arrested in October 2021 with the assistance of Cherokee County, Texas, deputies. James Smith was found driving back toward California with child sexual abuse material in his possession at the time of his arrest.

Theodore Smith was sentenced to 100 years in prison on December 20, 2024, and James Smith to 23 years to life.

On November 13, 2024, Theodore Smith, 90, pleaded no contest to 11 counts of committing forcible lewd acts upon a child and three counts of lewd acts upon a child. He also admitted a substantial sexual conduct allegation and aggravating factors that he was in a position of trust and that the crimes took planning and sophistication. James Smith, 66, pleaded no contest to two counts of committing lewd acts upon a child. The investigation revealed a deeply disturbing pattern of abuse: the victims, who were under the age of 5 when the abuse began, suffered for years at the hands of the Smith men. Charges against Theodore Smith stem from incidents that occurred in 1988, while charges against James Smith stem from incidents that occurred in 1993. The survivors had kept the secret of the abuse hidden for decades, confiding only in their spouses.

The statute of limitations posed a significant challenge in this case, as it often does in cases of child sexual abuse.

While the photographic and video evidence showed a long history of abuse, legal constraints kept charges from being filed for anything that happened prior to 1988. This exposes another important aspect in the pursuit of justice for survivors of child sexual abuse, where the statute of limitations can become an effective tool for abusers to escape accountability, even when the evidence against them is overwhelming.

Some of the molestation involved a conspiracy between James and Theodore Smith. James Smith also faced allegations of abusing another individual after 2010, and prosecutors said he was producing child sexual abuse material as recently as that year—conduct that resurfaced when he was found en route back to California with such material during his arrest.

Justice Served

It may have taken time—time that the statute of limitations made quite challenging—but finally, justice has been served. The long prison sentences handed down to Theodore and James Smith are proportional to the severity of their crimes and bring a measure of closure to the victims. “Although nothing can bring back what they lost,” the Orangevale homeowner said after the material was uncovered, “it’s not too late to have justice for them.”

The case is a sobering reminder of the life-long effects of child sexual abuse and how justice should be pursued, even decades later.
