Oklahoma father who killed 9-month-old son after attacking child’s mother gets life in prison

Hunter Smiley, a 25-year-old father, was charged with the savage murder of his own baby son. According to the Oklahoma State Bureau of Investigation (OSBI), on April 10, 2024, police were called to a Newcastle residence regarding a 9-month-old baby who was not responding. After being taken to the hospital immediately, the child died two days later, on April 12, from his injuries.

The boy had extensive hemorrhaging behind his eyes and severe internal bleeding in his brain, according to investigators. Smiley was tending to the child when the baby sustained the fatal injuries, according to Cleveland County District Attorney Greg Mashburn. Smiley was taken into custody by the authorities on April 15 and faced charges of first-degree murder.

On April 25, Smiley was arraigned, and a substantial $5 million bond was set. Mashburn stressed that Smiley’s release would be subject to stringent requirements, such as total disarmament, mandatory ankle monitoring, and a no-contact order with the victim’s family. The preliminary hearing was scheduled for May 22.

District Attorney Mashburn made a heartbreaking statement, saying, “This is a profound loss of a young life. In order to bring this voiceless victim’s case to justice, we are dedicated to vigorous prosecution.”

Regretfully, court records disclosed an earlier incident involving Smiley and the mother of the child. He was taken into custody by the authorities in January 2023 on charges of domestic assault and battery for allegedly physically abusing the pregnant woman, according to KFOR-TV. That June, Smiley entered a guilty plea to assaulting her during a quarrel, hitting her with pieces of a door he had broken during a fight after a night of drinking.

According to records, Smiley received a deferred sentence of 13 months’ probation from a McClain County judge, set to expire in July 2024. A no-contact protective order had been filed against him in that case, but the mother later asked for it to be lifted so Smiley could “be involved in the birth of the child.” His later arrest plainly broke a condition of that probation, which required him to comply with the law.

The case moved through the courts over the following year and a half. In October 2025, a McClain County jury found Smiley, by then 26, guilty of first-degree murder for the death of his infant son, with prosecutors presenting evidence that the baby died from injuries consistent with abuse.

On December 4, 2025, a McClain County judge sentenced Smiley to life in prison with the possibility of parole, closing out a case that began with a 9-month-old found unresponsive in a Newcastle home and ended with the child’s father convicted of his killing.
