Orangevale Home Remodel Exposed Decades of Child Sexual Assaults Before Father Theodore Smith and Son James Smith Were Sentenced

Title insurance covers defects in a deed. It does not cover a wall that has been used as an archive. In 2021 a buyer renovating an outbuilding at a house in Orangevale, California, found Polaroid photographs and videotapes that had been sealed inside the structure. The new owner called the Sacramento County Sheriff’s Office. Detectives opened a file that ran backward through four decades and then south to Texas.
The people who had lived in that house for more than forty years were Theodore Smith and his son James Smith. By the time investigators reached them they were living in Texas. On December 20, 2024, a Sacramento County judge sentenced Theodore Smith, 90 at arrest, to 100 years in prison. James Smith, 66 at arrest, received 23 years to life. The Sacramento County District Attorney’s Office announced the terms on January 7, 2025. The case number is 21FE017195.

On November 13, 2024, both men entered no-contest pleas. Theodore Smith pleaded to eleven counts of forcible lewd acts upon a child and three counts of lewd acts upon a child. He admitted a substantial-sexual-conduct allegation and aggravating factors that he occupied a position of trust and that the crimes involved planning and sophistication. The charged acts tied to him date to 1988.
James Smith pleaded to two counts of lewd acts upon a child. He admitted a multiple-victim allegation, a substantial-sexual-conduct allegation, and the same trust and planning aggravators. His charged acts date to 1993. Prosecutors also said he molested another person after 2010. Some of the conduct, the office said, involved a conspiracy between father and son.
California’s statute of limitations blocked charges for abuse before 1988. That is why the charging document starts where the clock still ran, not where the victims’ lives started. A hundred-year term for a 90-year-old man is not a rehabilitation plan. It is a statement that the file will outlive him. Twenty-three years to life for the son is a statement that parole, if it ever arrives, will have to look at more than a calendar.
When Texas authorities arrested the pair they found additional child sexual abuse material at the Texas residence. James Smith was stopped in a vehicle heading back toward California with more of that material in the car. The remodel in Orangevale did not close the case. It opened a second crime scene in another state.

Cold cases involving intra-family abuse usually die for lack of corroboration. Adult survivors are told that memory is unreliable and that there is no physical evidence. The Orangevale outbuilding supplied the missing object. Once detectives had the photographs they could find the people in them. That sequence should bother anyone who buys older housing stock. It should also bother anyone who works property transfers. There is no checkbox for “prior occupant may have used the walls as a vault.” Real-estate culture treats the past as a paint color. Criminal law treats the past as a venue. Those two systems do not talk unless a buyer is unlucky enough to put a hammer through the wrong panel.

Ore’s bureau does not often get a case that arrives through a contractor’s dumpster. When it does, the work after the discovery is the part that decides whether the finders’ shock becomes a sentence. Detectives had to locate victims who had spent decades building lives that did not include a courtroom. They had to persuade those adults that a no-contest plea in 2024 was still worth the cost of walking into a building with a father and son in it.
