The Nationwide Vape Flavor Ban Never Became Law. The Panic Still Handed the Market to Big Tobacco

In 2019, states and cities raced to ban vape flavors — nicotine and legal cannabis alike — while cable news treated every lung injury as proof that mango pods were killing teenagers. We published a projected timeline of what a nationwide flavor ban would actually do: shutter shops, dump adult smokers onto the same black market that made EVALI, hand the remaining legal product to cigarette companies that could afford a $100,000 PMTA, and arrest teenagers for carrying Juul pods.

That federal ban was never signed. The damage from the panic still happened, just in pieces.

States had already borrowed against future cigarette-tax revenue through tobacco bonds. When vaping cut cigarette sales, those bonds wobbled. More than half of Congress had taken cigarette money. A lot of the early U.S. « research » was tobacco-funded junk science. The United Kingdom, which actually studied the products, kept telling smokers to switch.

Michigan’s flavor ban was the test case. Legal-age customers were shoved toward street dealers. Shops sued. The DEA started kicking doors. EVALI, we now know, was vitamin E acetate in illicit THC carts — 2,807 hospitalizations, 68 deaths — not nicotine e-liquid. A flavor ban would have fed that market, not starved it.

What the FDA built instead was a paywall. Independent flavor companies could not float a six-figure application and a year of waiting. Big tobacco could. Pods got smaller and more expensive. The adult off-ramp from cigarettes narrowed.

Then the agency reversed itself. On May 5, 2026 the FDA authorized four Glas ENDS pods, including Gold and Sapphire — the first non-tobacco, non-menthol e-cigarettes cleared in the United States — bringing the authorized ENDS list to 45 products. Days later it posted enforcement-discretion guidance that lets certain unauthorized flavored e-cigarettes and nicotine pouches stay in stores while reviews grind on. Youth vaping has fallen from the 2019 peak. Among kids who still vape, about 88 percent still use a flavor. The black market never left. Combustible cigarettes still kill about 480,000 people a year in this country.

Banning flavors was never a public-health plan. It was a gift to the companies that already kill people at industrial scale. One-third of a police budget put into nicotine-addiction treatment, drug treatment, social programs, and public housing would have done more than any raid.
