Prosecutor Neil Cordero has told the court the state is still evaluating the case. Defense attorney Jason Goss said in May that the witness list already ran between forty and sixty people and that he believed there were more. The packet includes about sixty-three police reports from a South Side block that logged more than sixty calls in two years.

Texas does not file a standalone hate-crime count. A bias finding would be a punishment enhancement after a conviction. San Antonio police first said there was “no evidence whatsoever” that sexual orientation played a role. Chief William McManus later walked it back and apologized. He said the department spoke too early and that the question remains part of the investigation. That retraction is now part of the public record. A finding is not.
