Kenya&#8217;s 2017 carrier-bag ban still carries up to four years in prison or a fine of about $40,000. The World Bank had already reported that more than a third of Kenyans lived on under $1.90 a day. National Environment Management Authority officers said they found 500 bags. Twitter tore into <a href=\"https:\/\/nema.go.ke\/ban-on-plastic-carrier-bags\/\" target=\"_blank\" rel=\"noopener noreferrer\">NEMA<\/a> for hunting stall vendors while supermarket sausage, diapers, and tea boxes stayed wrapped in the same polymer.<\/p>\n<div class=\"embed-x\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">3 traders were arrested in Nairobi yesterday using banned plastic bags. About 500 pieces of the bags were seized. The trio are being presented in court today. NEMA&#8217;s own cattle study found plastic in more than half the stomachs near cities. Rwanda and Morocco banned bags too. Tanzania followed in 2019. On June 5, 2020 Kenya extended the rule to all single-use plastics in parks, beaches, and forests.<\/p>\n<h2>The Ban Tightened, Then the Bags Came Back<\/h2>\n<p>In April 2024 NEMA ordered organic and market waste collected only in fully biodegradable bags. Officials have cited enforcement above 80 percent and fewer blocked drains. Nairobi still produces about 2,400 tonnes of solid waste a day, a fifth of it plastic. Dandora is still a mountain of PET the original bag law never touched. Cheap polythene keeps walking in over the borders.<\/p>\n<p>November 2024 closed the loopholes manufacturers had been using. Production of plastic bags for any purpose was banned outright, and so was importing them \u2014 even the duty-free sack in a traveler&#8217;s suitcase. Manufacturers got 30 days to declare stock. December 2024 made Extended Producer Responsibility law under Legal Notice 176: every packaging producer, not just plastic, has to register with NEMA, take a Producer Responsibility Number, and file a four-year plan for what happens after the customer is done with the wrap. Registration closed May 4, 2025. Legal Notice 181 added labeling rules \u2014 resin codes, recycled-content percentages, producer contact \u2014 with an August 30, 2025 deadline.<\/p>\n<p>January 2025 widened the net again: straws, cutlery, sachets, and expanded polystyrene food containers. In late 2025 Kenya launched a &#8220;NO SUP USE&#8221; campaign under the Kenya Plastics Pact, pushing hotels to drop problem plastics by 2030. September 2025, NEMA said banned bags were reappearing in retail outlets and relaunched a crackdown, warning of fines up to 4 million Kenyan shillings or two years in prison. In April 2026 the authority started demanding registered producers prove, within seven days, exactly how their EPR fees are spent across the waste chain. A June 2025 <em>Science<\/em> paper, drawing on more than 600 bag policies, found a 25 to 47 percent drop in bags on shorelines where bans exist. Nobody in America is looking at four years in a cell for a market sack. California still argues over a fee at the register while <a href=\"https:\/\/theaegisalliance.com\/2017\/12\/12\/nestle-exposed-bottling-water-expired-permits-factor-california-wildfires-drought\/\">Nestl\u00e9 bottled water on expired permits through a drought<\/a>. That gulf is the point of this file: the people selling fruit in Nairobi take the handcuffs, the people selling volume packaging take the exemption.<\/p>\n<p>The AEGIS Alliance is not here to romanticize a prison sentence for a produce bag. We are here to say a law that jails a stall vendor and leaves Dandora standing is a performance until the industrial waste stream is in the same dock.
