In May 2025 a federal judge in Honolulu said they were not imagining it. The government was liable. The checks that followed were a fraction of what the harm was worth, and a 1950 Supreme Court doctrine is still being used to shut active-duty plaintiffs out of the same courtroom.<\/p>\n<p>The Red Hill Bulk Fuel Storage Facility sat above Oahu&#8217;s aquifer. In May 2021 a piping failure dumped jet fuel into a fire-suppression line. It sat there, undetected, until November 20\u201321, 2021, when a second accident pushed it into the drinking water of about 93,000 people. Residents smelled fuel. The state health department issued an advisory. Navy officials denied there was a problem and asked the state to take the warning back. Then they admitted it. A 2014 leak of roughly 27,000 gallons had already put the tanks on notice. Public pressure eventually forced the military to defuel them.<\/p>\n<p>Feindt v. United States was filed in August 2022 under the Federal Tort Claims Act. In April 2024, U.S. District Judge Leslie Kobayashi ran a two-week bellwether trial with 17 plaintiffs \u2014 military spouses and family members chosen to stand in for thousands of others. The government had already admitted negligence and a &#8220;nuisance.&#8221; It still argued the rashes, gut problems, and worse were not the fuel. Nastasia Freeman, a military spouse, said her family&#8217;s symptoms started like the flu and got worse, pets included. &#8220;We were essentially lied to,&#8221; she said. &#8220;They insisted it was alright even though we knew the water was dangerous.&#8221;<\/p>\n<h2>A Win on Paper, Pennies on the Harm<\/h2>\n<p>Kobayashi found the Navy liable and ordered about $680,000 for the 17 bellwether plaintiffs, from roughly $5,000 to just over $104,000 each. Attorneys said the ruling established that the contamination reached every neighborhood on the Navy line and that the illnesses were not &#8220;psychosomatic.&#8221; It is treated as the first successful military water-contamination case of its kind against the federal government. Lead attorney Kristina Baehr had asked for something closer to $225,000 to $1.25 million per person. Pretrial rulings narrowed what could be proved. Baehr called the numbers &#8220;disappointing&#8221; and said the families still &#8220;prevailed against all odds.&#8221;<\/p>\n<p>About 7,500 other claims from service members, dependents, and civilians remained. In May 2026 Kobayashi ruled that the Feres doctrine \u2014 the 1950 precedent that bars troops from suing for injuries &#8220;incident to service&#8221; \u2014 blocks active-duty plaintiffs even as civilian family members keep their awards. Baehr has said they will take that question as far as the Supreme Court.
