The only count he admitted was possession of child pornography. When prosecutors made the judgment public on October 2, the facts they described were narrower than the indictment and wider than a simple download.<\/p>\n<p>Between 2022 and 2023, they said, Davison used an internet-based app, a laptop, and cellphones to alter photographs of clothed minors he already knew. The software removed the children&#8217;s clothing and replaced it with computer-generated bodies, so the files appeared to show those minors engaged in sexually explicit conduct. Investigators also found additional child sexual abuse material that was not described as computer-made. A grand jury in September 2025 charged four counts of receipt and one count of possession. In April 2026 he pleaded guilty to possession alone.<\/p>\n<p>The South Dakota Internet Crimes Against Children Task Force, the South Dakota Division of Criminal Investigation, and the Box Elder Police Department built the case. Box Elder sits on the eastern edge of Rapid City. Sentences in this division are imposed at the Andrew W. Bogue Federal Building and United States Courthouse, 515 Ninth Street.<\/p>\n<h2>What Prosecutors Say Kevin Davison Did With Photos of Minors He Knew<\/h2>\n<p>Prosecutors did not name the app, say how many children were depicted, or say whether any file left his devices. They did say the children were minors he knew, that the source photos showed them clothed, and that the altered files depicted sexual conduct. A download of abuse imagery harms a child the offender has never met. A file built from a photograph of a child in his own life adds a second injury, because that child can be recognized. The announcement does not say whether the families were told if any file spread.<\/p>\n<p>The same week, a Nashville station reported that a former FBI agent expects more files of this kind, after a Tennessee sentence six times as long.<\/p>\n<div class=\"embed-x\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">A former FBI agent says investigators should expect more cases involving AI-generated child sexual abuse material after a Portland man was sentenced to 30 years in prison. <a href=\"https:\/\/t.co\/HDS7JU5dI8\">https:\/\/t.co\/HDS7JU5dI8<\/a><\/p>\n<p>Prosecutors say Patrick D. Swanson, 30, of Portland, Tennessee, was sentenced on September 24. Prosecutors said he placed children&#8217;s faces onto sexual images and videos, then traded that material with a person in Canada for real abuse files. Canadian police found the messages. Portland police, the FBI, the Tennessee Bureau of Investigation, and Homeland Security arrested him in November 2025, and he deleted material as officers arrived. Judge Dee David Gay imposed 30 years with no probation, parole, or early release, <a href=\"https:\/\/www.wsmv.com\/2026\/09\/25\/middle-tennessee-man-sentenced-30-years-using-ai-create-trade-child-pornography\/\" target=\"_blank\" rel=\"noopener\">WSMV reported<\/a>. Both men were accused of starting with real children. The gap between five years and 30 is a gap in charges, not in whether software made the files.<\/p>\n<figure id=\"attachment_1204502\" aria-describedby=\"caption-attachment-1204502\" style=\"width: 1400px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-1204502\" src=\"https:\/\/theaegisalliance.com\/wp-content\/uploads\/digital-forensics-internet-crimes-devices.jpg\" alt=\"Examiner seen from behind reviews laptops in a dim digital forensics lab\" width=\"1400\" height=\"787\" \/><figcaption id=\"caption-attachment-1204502\" class=\"wp-caption-text\">Examiners start with the phones and laptops already in a suspect&#8217;s hands.<\/figcaption><\/figure>\n<h2>Why a Possession Plea Still Produced a Five-Year Federal Prison Term<\/h2>\n<p>Receipt and possession are not the same crime, and the indictment tried to prove both. Under <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/2252\" target=\"_blank\" rel=\"noopener\">18 U.S.C. \u00a7 2252<\/a>, receipt of child pornography ordinarily carries a mandatory minimum of five years and a maximum of 20. Possession, without a qualifying prior conviction, ordinarily carries no minimum and a maximum of 10. Nothing in the public announcement describes such a prior. Davison admitted the count with the lower ceiling. Five years is the midpoint of that zero-to-ten range, and it matches the floor he would have faced on the receipt counts the plea extinguished.<\/p>\n<p>Five years of supervised release is the minimum <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/3583\" target=\"_blank\" rel=\"noopener\">18 U.S.C. \u00a7 3583(k)<\/a> sets for many of these convictions, a term that can run for life. Restitution is mandatory under <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/2259\" target=\"_blank\" rel=\"noopener\">18 U.S.C. \u00a7 2259<\/a>. Prosecutors said restitution and court fees were ordered. They did not publish the figures.<\/p>\n<p>This courthouse has gone longer when the admitted count was receipt. On March 9, U.S. District Judge Camela C. Theeler sentenced David Derby, 29, of Box Elder, to 15 years for receipt of child pornography, plus 10 years of supervised release, <a href=\"https:\/\/drgnews.com\/2026\/03\/24\/box-elder-man-sentenced-to-15-years-in-federal-prison-for-receipt-of-child-pornography\/\" target=\"_blank\" rel=\"noopener\">DRG News reported<\/a>. That case was not an artificial-intelligence case. A plea to receipt produced a term three times as long. Davison was indicted the same month. Only the possession count survived. The government started with five counts, finished with one, and still imposed the mandatory floor of the counts that were dismissed.<\/p>\n<h2>How the Morph Statute Treats AI Images of Identifiable Minors<\/h2>\n<p>Congress defined child pornography to include a picture created, adapted, or modified to appear that an identifiable minor is engaging in sexually explicit conduct. That language is <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/2256\" target=\"_blank\" rel=\"noopener\">18 U.S.C. \u00a7 2256(8)(C)<\/a>. An identifiable minor includes a person whose image as a minor was used in the alteration and who is recognizable by face or likeness. A clothed photograph of a real child, altered until the child appears to be engaged in sexual conduct, is what that paragraph covers. Lawyers call the result a morph.<\/p>\n<p>In <a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/00-795\" target=\"_blank\" rel=\"noopener\">Ashcroft v. Free Speech Coalition<\/a> (2002), the Supreme Court struck down a ban on virtual images that merely appeared to depict a minor, where no real child was used. Congress answered in 2003 with the PROTECT Act, so imagery modified to depict an identifiable minor stayed criminal. The claim that a model makes the file legal fails when the child in the source photo is real.<\/p>\n<p>A ruling on August 25 does not rescue this case. In United States v. Anderegg, the Seventh Circuit upheld dismissal of private-possession charges built on more than 13,000 sexual images prosecutors could not tie to any actual child, and left production, distribution, and transfer charges standing. The opinion binds courts in Illinois, Indiana, and Wisconsin, and it is about wholly synthetic files. <a href=\"https:\/\/enoughabuse.org\/ai-csam-ruling-what-the-seventh-circuits-anderegg-decision-means-for-child-safety\/\" target=\"_blank\" rel=\"noopener\">Enough Abuse<\/a> noted that 47 states already criminalize computer-edited abuse imagery in some form.<\/p>\n<p>Riana Pfefferkorn and Cyndie Demeocq examined 71 federal prosecutions filed from 2022 through the end of 2025. In <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=7474438\" target=\"_blank\" rel=\"noopener\">Yes, It&#8217;s Already Illegal<\/a>, they report that most ended in conviction, that prison terms ran higher than average, and that the First Amendment had not blocked them. Lawmakers folded the idea into a broader rewrite. William Webster Bragg, 56, of Aberdeen, became the first person indicted under that law, on distribution and possession counts tied to conduct on or about August 13, 2024. &#8220;Computer-generated child pornography, including those images and videos created using artificial intelligence, has become an increasing concern nationwide and in South Dakota,&#8221; Jackley said in the release quoted by <a href=\"https:\/\/www.newsfromthestates.com\/article\/aberdeen-man-becomes-first-charged-under-new-law-banning-computer-generated-child-porn\" target=\"_blank\" rel=\"noopener\">News From The States<\/a>. Davison&#8217;s case is the older path. The conduct runs through 2022 and 2023, and the charges were brought in United States District Court.<\/p>\n<p><a href=\"https:\/\/southdakotasearchlight.com\/2026\/01\/08\/former-drivers-licensing-employee-accused-of-targeting-50-victims-in-ai-pornography-case\/\" target=\"_blank\" rel=\"noopener\">South Dakota Searchlight reported<\/a> on January 8 that the investigation of Mark Rathbun, a former driver&#8217;s license examiner in Aberdeen, had reached at least 50 victims, including computer-generated sexual images of real children. Those are charges, not a sentence. In Brookings County, Alexander Clelland, 31, faces five manufacturing counts and five possession counts after cyber tips in late July, <a href=\"https:\/\/www.keloland.com\/news\/local-news\/brookings-man-accused-of-making-child-porn-with-ai\/\" target=\"_blank\" rel=\"noopener\">KELOLAND News reported<\/a>. Court papers say he told investigators he used artificial intelligence on photographs of real children. He has not been sentenced.<\/p>\n<p>Earlier in September, a Utah anchor posted a possession case that closed on the same prison number, with a much longer tail of supervision.<\/p>\n<div class=\"embed-x\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Southern Utah man going to prison for possessing sexually explicit AI photos of children <\/p>\n<p>Jared Marsh, 49, of Santa Clara, pleaded guilty on May 4 to possession of child pornography. Same admitted count. Same age. Lifetime supervision instead of five years. On September 8 in Columbus, James Strahler II, 37, received 15 years after pleading guilty to cyberstalking, producing obscene visual representations of the sexual abuse of children, and publication of digital forgeries. The department called him the first person convicted under the Take It Down Act, a 2025 law covering nonconsensual publication of intimate images and computer-made forgeries. Prosecutors said he installed more than 24 artificial-intelligence platforms and created more than 700 images, the <a href=\"https:\/\/www.justice.gov\/usao-sdoh\/pr\/columbus-man-sentenced-15-years-prison-cyberstalking-exes-creating-ai-generated\" target=\"_blank\" rel=\"noopener\">Southern District of Ohio<\/a> reported. Davison&#8217;s conduct, dated to 2022 and 2023, predates that statute. The announcement does not say the files were shared. Supervised release can restrict computers and bar contact with minors, but those conditions bind the defendant, not the copies. Restitution is a money judgment, not a deletion order.<\/p>\n<p>Readers tracking how these investigations end can look at <a href=\"https:\/\/theaegisalliance.com\/2026\/07\/02\/operation-guardian-arrests-21-men-in-snohomish-county-washington-for-child-sex-crimes\/\">Operation Guardian, which produced 21 arrests in Snohomish County<\/a>, and at a <a href=\"https:\/\/theaegisalliance.com\/2019\/10\/18\/337-arrested-worldwide-dark-web-child-porn-bust\/\">dark-web bust that caught 337 people<\/a>. The tool in the Rapid City case is newer than those files. The charging theory is not. Possession of a picture modified so an identifiable child appears to be abused was already a federal crime when, on the government&#8217;s account, Davison pointed an app at photographs of minors he knew.
