Jerome Gutierrez of Hillsborough, California, was asleep and buckled into a business-class seat on December 27, 2024, when another man stood over him and urinated on him. The airplane had left San Francisco International Airport for Manila about four hours earlier. Gutierrez’s stepdaughter, Nicole Cornell, told SFGATE he first thought he was dreaming. Then he understood he was soaked from his stomach down in the other man’s urine, through his clothes and, in one account she gave reporters, down to his feet.

The sector from San Francisco to Ninoy Aquino International Airport runs on the order of fourteen to fifteen hours. Family accounts said Gutierrez stayed in the soaked clothes for about eight more hours. United later handed him pajamas. Flight attendants, Cornell said, told him not to approach the man because they feared a confrontation and thought the man could become violent. The airplane did not turn around. It kept the Pacific in front of it. The man later apologized to Gutierrez and his family and, Cornell said, begged them not to press charges.

United spokesperson Anoushah Rasta confirmed to SFGATE that there had been « a passenger disturbance, » that the airline asked police to meet the aircraft when it arrived in Manila on the morning of December 28, and that « we have banned this passenger. » The airline has not named him. A cabin that stays on the filed route is cheaper. Urine on skin for the rest of a transpacific night is a medical and dignity problem, not a linen problem. Pajamas are an admission that the clothes were ruined. They are not a decontamination plan, and they do not answer why the sleeping person was treated as the risk.

Business class is sold as a quieter room with more crew attention. It is still a tube with a locked flight deck and one usable exit strategy: land. A man who stands up and uses a sleeping stranger as a toilet is not a messy traveler. He has decided another body is available. The seatbelt that was supposed to keep Gutierrez safe in turbulence also kept him in place while it happened. Premium cabins do not come with a lock on the person in the next pod.

Airlines spent years writing conduct rules for masks, shouting, and fistfights, because a fight at cruise altitude is an obvious safety event. This sat in a colder category. It was quiet enough that a crew’s first documented instinct, according to the family, was to keep the victim away from the offender. That inversion is how a company thinks when it is pricing a diversion and a headline, not when it is looking at a biohazard on a passenger who cannot leave.

🚨‼️STRANGE TIMES; EVEN STRANGER CRIMES:⚠️BANNED FROM THE SKIES: Passenger Urinates on Fellow Flyer During UA Flight 189

STRANGE TIMES EVEN STRANGER CRIMES

A man has been banned from United Airlines after allegedly urinating on another passenger during UA Flight 189 from San… pic.twitter.com/GdKGrHIi3H

— Kristy Tallman (@KristyTallman) January 4, 2025

A Ban Is Not a Charge

An airline ban is a contract penalty. It keeps one person off one carrier’s metal if the reservation system actually enforces it. It does not create a conviction. It does not publish a name in a courthouse. It does not automatically warn the next airline. A man United will not fly can, in principle, buy a seat on another carrier the next morning. That is why families in these cases keep asking for a police report, and why a report that starts with officers in another country can stall before it becomes a public case in California.

The legal lanes are real even if none of them has a public caption yet. A U.S.-registered air carrier in flight sits inside the special aircraft jurisdiction described in federal transportation law. Congress has pulled certain assault-type conduct in that jurisdiction into federal criminal law, which means a prosecutor does not have to pretend the Pacific is a legal vacuum. Philippine authorities had the first officers on the airplane, on December 28, and they can charge what their penal code covers. A civil suit in California is a third path. It does not need a criminal caption. Gutierrez can sue the man if he can be identified. He can also ask whether a common carrier’s response — a warning not to confront, pajamas, a ban after landing — met the duty owed to a passenger who woke up covered in someone else’s urine.

Intoxication will be the defense anyone offers first. Cornell did not describe a medical collapse. She described a man who finished, apologized, and then asked not to be charged. An apology is evidence that he understood what he had done. It is not a diagnosis, and it is not a reason for an airline to stop at the word « disturbance. »

What the File Still Does Not Contain

No toxicology has been released. No name has been released. No court date has been announced in the reporting that followed the flight through 2025 and into 2026. That silence is not proof the case is closed. It is proof the story United preferred was finished on the day of the ban. The family’s story is a name, a medical note, and a charging decision. Those are not the same document.

Long-haul cabins pack strangers into a room they cannot leave, sell them alcohol, and dim the lights. Crews are trained to de-escalate because a brawl is a safety problem. The training has a blind spot when the harm is not a fight. A sleeping passenger cannot de-escalate. A crew that treats him as the person who might « cause a scene » has already chosen a side. The AEGIS Alliance is not asking for a safety card that diagrams this act. The ask is smaller and harder: a name and a charge, from Manila or from a U.S. attorney, on a file that currently ends in a frequent-flyer penalty.

Shared vehicles only work when one passenger is not allowed to treat another as furniture. A different California arrival that failed its people is the Fullerton warehouse strike that killed a pilot and his teenage daughter. A different ledger of what travelers leave behind is the railway lost-and-found list that treated forgotten objects as a catalog. More of this desk lives in odd news and international news, though the jurisdiction question is not a joke. Until a prosecutor speaks, the record is this. UA 189 left San Francisco on December 27. Four hours later a man urinated on Jerome Gutierrez while he slept. The crew managed the victim. Police met the flight in Manila. United banned the offender and would not name him. The family called that a failure. It is still an open passenger-safety case.

Jerome Gutierrez woke up soaked on United Flight 189.
